Terms of Service
The terms that apply to the zevani.ai website and to Zevani's automated receptionist service.
At a glance

1. Agreement to these Terms
These Terms of Service ("Terms") govern your use of the zevani.ai website and Zevani's automated receptionist service (together, the "Service"), provided by Zevani ("Zevani," "we," "us," or "our").
By using the website, applying for the Service, or using the Service, you agree to these Terms. If you use the Service for a business, "you" means that business, and you confirm that you are authorized to accept these Terms for it. Our Privacy Policy explains how we handle personal information.
2. Customer agreements
Before we activate the Service for a business, that business and Zevani sign or accept a written service agreement, such as a Founding Customer Service Agreement (a "Customer Agreement"). The Customer Agreement sets out customer-specific details, including pricing. These Terms apply together with it. If a Customer Agreement conflicts with these Terms, the Customer Agreement controls for that customer.
Submitting an application on our website does not create a subscription or a Customer Agreement. Zevani decides whether to accept each application. Offers described on our website, including the limited number of founding spots, are subject to availability and to a Customer Agreement.
3. The Service
Zevani provides an automated, AI-powered phone receptionist for local service businesses. Once it is set up on a phone number configured for your business, the receptionist can:
- answer incoming calls and tell callers it is an automated receptionist;
- answer caller questions using the business information you provide and approve;
- collect caller details such as name, phone number, email address, and the service needed;
- take callback and appointment requests; and
- email a summary of each call to the notification address you choose.
Unless your Customer Agreement says otherwise, the Service does not: book confirmed appointments on a calendar; transfer calls to a live person; provide emergency dispatch or triage; send text messages; handle conversations in languages other than English; or connect to your own CRM or other software.
We provide founder-assisted onboarding and reasonable email support.
4. Eligibility and authority
The Service is for businesses, not for personal, family, or household use. You must be at least 18 years old and able to form a binding contract. If you accept these Terms for a business, you must have authority to bind that business.
5. Your business information
The receptionist relies on the information you give us. You are responsible for making sure the business information you provide and approve is accurate, complete, lawful, and kept up to date, including:
- business hours, holiday hours, and locations;
- the services you offer and don't offer, and your service area;
- what the receptionist may say about pricing, if anything;
- statements the receptionist may make and statements it must never make;
- how to handle appointment requests and callback requests;
- whether you offer urgent or emergency service, and how urgent requests should be handled; and
- the email address where call summaries should be sent.
We set up the receptionist using the information you approve and may test it before activation. Tell us promptly when anything changes. Until we make a change, the receptionist continues to use the information on file. We may decline to configure statements or instructions that we believe are inaccurate, unlawful, unsafe, or that would override the receptionist's safety rules.
6. Your other responsibilities
You are responsible for:
- following up with callers, including returning calls and confirming appointment requests. Zevani does not perform your services, and your relationships with your customers and callers are your own;
- regularly checking the email address where call summaries are sent, and telling us if it changes;
- setting up and maintaining your own phone arrangements, such as forwarding calls to the number Zevani answers. We recommend keeping another way for callers to reach you;
- complying with the laws that apply to your business and your use of the Service, including any notices you are required to give your own customers about how you handle their information; and
- keeping your account contact information current.
7. AI limitations
The receptionist uses artificial intelligence and speech recognition, and these technologies are imperfect. The receptionist may mishear or misunderstand callers, record details incorrectly, give incomplete or incorrect answers, or fail to respond as intended. Calls may also be dropped or go unanswered because of technical problems.
Zevani uses safeguards to reduce these risks, but we do not guarantee that the receptionist's responses, transcripts, or call summaries will be accurate or complete. Confirm important details, such as contact information and appointment times, directly with callers before relying on them. Do not rely on the Service as the only way to handle calls if a missed or mishandled call could cause harm.
8. Not an emergency service
Zevani is not an emergency service and is not a substitute for 911 or any other emergency service.
The receptionist is not designed to assess emergencies, send help, or contact emergency services. If a caller describes a possible emergency, such as a gas leak, carbon monoxide alarm, fire, electrical danger, or medical emergency, the receptionist is designed to tell the caller to get to safety and call 911, and to flag the call in the summary sent to you. It may not recognize every emergency.
You are responsible for your own emergency procedures and for any urgent or after-hours service you offer your customers. Do not instruct the receptionist to tell callers that it can send emergency help or guarantee a response time.
9. Appointments, callbacks, and transfers
The receptionist takes appointment requests, not bookings. A time a caller asks for is a request for you to confirm, and nothing is added to your calendar. The receptionist cannot transfer calls to a live person. When a caller asks for a person or needs a callback, the receptionist records the request so you can follow up. Where your business information allows it, the receptionist may tell callers that someone will call them back, but it does not promise a callback time.
10. Call summaries and email delivery
After each call, we send a summary by email to the notification address you choose, once that address has been verified. Email can be delayed or fail to arrive, for example because of spam filtering, an incorrect or full mailbox, or an outage or authorization problem at an email provider. We do not guarantee that any summary will be delivered, or delivered by a particular time. Contact us if you stop receiving summaries or think a call was missed.
11. Fees and billing
Your fees are set out in your Customer Agreement. Our current Founding Customer Plan, offered to a limited number of accepted founding customers (the first five), is:
- $199 per month base fee;
- $0 setup fee;
- 400 minutes of calls included in each monthly billing period;
- no free trial. The first monthly fee is due and charged when your service is activated, and the base fee then recurs monthly while the Service is active; and
- a 12-month rate lock. The $199 monthly base fee will not increase during your first 12 months of continuous subscription.
Payments are made through a payment link or invoice from our payment processor. Fees are in U.S. dollars and do not include taxes. You are responsible for any applicable taxes, which may be added where required by law.
If a payment is not received when due, we may suspend the Service after giving you notice. Outside any rate lock in your Customer Agreement, we may change fees for future billing periods by giving you at least 30 days' notice by email.
12. Included minutes and overage
Usage is measured from the call-duration records of our telephone provider. Usage above your plan's included minutes may be billed at the overage rate in your Customer Agreement. For the Founding Customer Plan, that rate is $0.20 per minute above 400 minutes in a monthly billing period. Zevani reviews usage manually before billing any overage, and no overage is charged automatically.
13. Term, cancellation, and refunds
The Service is month-to-month and continues each monthly billing period until cancelled. You can cancel at any time by emailing [email protected] from an authorized contact for your business. Cancellation takes effect at the end of your current paid period, and the Service continues until then. Payments are not prorated or refunded, except where required by law.
14. Third-party services
The Service depends on third-party providers, including telecommunications (Twilio), AI models (Anthropic), email (Google and Brevo), website hosting and networking (Cloudflare), and payment processing (Stripe). Their availability and performance are outside our control, and outages or changes on their side may affect the Service. We are not responsible for third-party services we do not control. If you use a third-party service directly, that provider's own terms apply.
15. Acceptable use
You agree not to use the Service, or let anyone else use it, to:
- break any law or regulation, or infringe or violate anyone's rights;
- mislead callers, including by instructing the receptionist to make false statements or to claim to be a human;
- collect payment card numbers, bank account details, government identification numbers, health information, or other sensitive personal information through the receptionist;
- harass, threaten, or abuse anyone, or to make or support unwanted or unlawful calls or messages;
- interfere with or disrupt the Service, or try to access it, its systems, or other customers' information without authorization; or
- copy, resell, or reverse engineer the Service, except where the law allows it or we agree in writing.
16. Your data
"Customer Data" means the business information you provide and the call information the Service collects for you, such as transcripts, caller details, and call summaries. As between you and Zevani, you own your Customer Data.
You give Zevani a non-exclusive license to host, copy, process, transmit, and display Customer Data as needed to provide, maintain, secure, and support the Service, and to diagnose and fix quality problems (for example, by reviewing call transcripts). We do not sell Customer Data, and we do not use it to train generalized AI models. We handle personal information as described in our Privacy Policy. You are responsible for having the rights and giving the notices needed for us to process Customer Data on your behalf.
We may use aggregated or de-identified information about how the Service is used, which does not identify you or any caller, to operate and improve the Service. If you send us suggestions or feedback, we may use them without any obligation to you.
17. Intellectual property
Zevani and its licensors own the Service, the website, the software behind them, and the Zevani name and logo, including all related intellectual property rights. While your subscription is active and subject to these Terms, you may use the Service for your internal business purposes. No other rights are granted.
18. Confidentiality
Each of us may receive non-public information from the other that is marked confidential or that should reasonably be understood to be confidential, such as your non-public business information or Zevani's non-public pricing and technical information. The receiving party will use that information only for the Service and our business relationship, protect it with reasonable care, and share it only with people and providers who need it for those purposes and are required to protect it, or as the law requires.
These obligations do not apply to information that is or becomes public through no fault of the receiving party, was already known to it, is independently developed, or is lawfully received from someone else. If your Customer Agreement has confidentiality terms, those terms control.
19. Service availability and changes
We work to keep the Service running, but we do not promise that it will be uninterrupted or error-free. No uptime, response-time, or performance commitment (service level agreement) applies unless your Customer Agreement expressly includes one. The Service relies on third-party providers, internet connectivity, and systems operated by Zevani. It may be unavailable because of maintenance, outages, or events beyond our control, and calls made while it is unavailable may not be answered. We do not guarantee any particular number of leads, bookings, sales, or revenue.
We may change, add, or remove features. If we make a change that materially reduces the core Service you have paid for, we will tell you, and you may cancel as described in Section 13.
20. Suspension and termination
We may suspend or end your access to the Service if you materially breach these Terms or your Customer Agreement, including by not paying, and do not fix the breach within a reasonable time after we notify you. We may suspend the Service immediately if your use creates a security, legal, or safety risk, or if the law requires it.
We may also stop offering the Service to you by giving at least 30 days' notice. If we do, we will refund any fees you prepaid for the period after the Service ends.
When your access ends, your right to use the Service ends. Sections that by their nature should continue, including fees owed, your data, intellectual property, confidentiality, disclaimers, limitation of liability, indemnification, governing law, and general terms, continue after termination.
21. Disclaimers
To the fullest extent permitted by law, the Service and the website are provided "as is" and "as available." Except as expressly stated in these Terms or your Customer Agreement, Zevani disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Zevani does not warrant that the Service will be uninterrupted, error-free, or secure, that every call will be answered or handled correctly, or that call summaries will be accurate, complete, or delivered.
22. Limitation of liability
To the fullest extent permitted by law:
- neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, business opportunities, leads, or data, including losses from missed or mishandled calls, even if it was told such damages were possible; and
- each party's total liability arising out of or relating to the Service or these Terms will not exceed the fees you paid Zevani for the Service in the 12 months before the event that gave rise to the liability, or $100 if you have not paid any fees.
These limits do not apply to your obligation to pay fees, to your indemnification obligations, or to any liability that cannot be limited under applicable law.
23. Indemnification
You will defend and indemnify Zevani against third-party claims, and the resulting losses and reasonable costs, arising from: (a) the business information and instructions you provide, including statements the receptionist makes based on them; (b) your services, products, or dealings with your customers and callers; or (c) your violation of the law or these Terms. Zevani will notify you promptly of any such claim and cooperate reasonably. You will not settle a claim in a way that places obligations on Zevani without Zevani's consent.
24. Governing law and disputes
These Terms are governed by the laws of the state in which Zevani's principal place of business is located, and by applicable United States federal law, without regard to conflict-of-law rules. If your Customer Agreement specifies a governing law or dispute process, that agreement controls.
If a dispute arises, please contact us first at [email protected]. Both parties agree to try in good faith to resolve the dispute informally for at least 30 days before starting a formal proceeding, except when a party seeks urgent relief to protect its rights.
25. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the updated Terms on this page with a new effective date. If we make material changes, we will notify our customers by email before the changes take effect. By continuing to use the Service after the changes take effect, you accept the updated Terms. Changes to these Terms do not change the pricing or other commercial terms in your Customer Agreement unless you agree.
26. General terms
- Entire agreement. These Terms, our Privacy Policy, and any Customer Agreement are the entire agreement between you and Zevani about the Service.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. Not enforcing a provision right away does not waive it.
- Assignment. You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition, or sale of our business or assets.
- Notices. We may send notices to the email address we have on file for you. You may send notices to [email protected].
- Events beyond our control. Neither party is responsible for delays or failures caused by events beyond its reasonable control, such as outages at telecommunications, internet, or cloud providers. This does not excuse payment obligations.
- Relationship. The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
- No third-party beneficiaries. These Terms do not give rights to anyone else, including callers.
